I filed a lawsuit against my life insurance company in Tallahassee. I won my case against my long-term disability insurance company and paid the retroactive amount of my policy benefits plus interest. What else should I collect?

Good question, Andrew.

Simply put, you may be entitled to money for suffering, pain, distress, punitive damages, and bad faith as your claim for what’s legally called “exemplary damages”. Although bad faith claims would vary from state to state. You can also recover your attorney fees, either per hour or contingent fee basis. Also, since your sense of security was disrupted, there is such claim that’s called “an infliction of emotional distress claim”, which is normally caused by acts done in bad faith.

This can happen in very rare case, but if your insurance company in Tallahassee FL committed fraud, oppression, or malice to deny your claim, it can be liable for punitive damages, which will be bound by proof in court.
